Fees for information about a property
1. (1) A fee of $65 is payable to the Ministry by a person who requests a statement containing information about the existence of records in the custody or under the control of the Ministry that are related to a property.
(2) For greater certainty, subsection (1) does not apply in respect of a request for access to a record pursuant to the Freedom of Information and Protection of Privacy Act.
Refund
2. The Ministry may refund all or part of a fee paid under section 1 if, in the opinion of the deputy minister of the Ministry or an authorized delegate of the deputy minister, it is fair and equitable to make the refund having regard to any relevant factors, including any service standards set out by the Ministry.
